CONTEST RULES — Xandres Scratch & Win

Article 1. General

These rules apply to the contest or promotional event by Xandres NV described below, hereinafter referred to as “the Contest”.
The Contest is organised by the limited liability company Xandres NV, with its registered office at Nijverheidsstraat 20, 9070 Destelbergen and registered in the Belgian Kruispuntbank van Ondernemingen (chamber of commerce) under company number 0639.856.936, hereinafter referred to as the “Organiser”. In some cases, the Contest is also organised in cooperation with a third-party partner, called a “Contest Partner”, who offers the prize or prizes to the winner(s). However, the Organiser will remain responsible for the organisation and course of the Contest.
Among other things, these rules relate to the conditions for participation in the Contest and the course of the Contest. The mere act of participation in the Contest implies full acceptance by the participant of all the terms and conditions of these Contest Rules.
These rules can be viewed on the Organiser's website, www.xandres.com, and obtained from the Organiser upon first request via email.
The Organiser reserves the right to change the rules at any time, without prior notice and without justifying its decision. This change will apply to each participant and will be published on the Organiser's website or social media channels. 
The Organiser reserves the right to terminate the Contest at any time if it is confronted with certain cases of fraud, without prior notice, without justifying its decision, and without an obligation compensate participants.

 

Article 2. Term

Scratch & Win: The Contest starts on 10/03/2023 and ends on 12/03/2023. The Organiser reserves the right to extend the Contest.

 

Article 3. Conditions of participation

Scratch & Win: The Contest is only open to Xandres customers who made a purchase during the term of the Contest. Participants must be able to present their scratch card to the Organiser at all times.

Scratch & Win: Customers will receive a scratch card with each item purchased during the term of the Contest :

  • Retail : scratch card can be scratched directly at checkout
  • Web: scratch card is included in the box upon delivery
  • Wholesale : cratch card can be scratched directly at checkout.

The Contest is open to all natural persons, with the exception of staff members and directors of the Organiser and any partners involved in the organisation of the Contest (e.g., marketing agency). First-degree relatives of such individuals and those residing at the same address as such individuals are also excluded from participation.
Contest participants must reside within the following area: Belgium, the Netherlands, Luxembourg

 

Article 4. The course of the Contest

Om geldig deel te nemen en dus kans te maken op de prijs dient de deelnemer het hierna beschreven wedstrijdverloop correct en volledig te volgen. De Wedstrijd verloopt als volgt:

Kras & Win: De deelnemers ontvangen een kraslotje bij hun aankoop en kunnen onmiddellijk de kraslaag op hun kraslot verwijderen met een hard voorwerp om te zien welke prijs zij gewonnen hebben. Via de QR-code op het kraslot kunnen de deelnemers zich vervolgens online registreren waarbij zij:

  1. hun persoonsgegevens (naam, voornaam en e-mailadres) invullen
  2. een kennisvraag invullen op het deelnameformulier

 

Article 5. Winning scratch card

If a winning scratch card is presented

Scratch & Win:
Retail :

  • The scarf/book can be given directly to the customer with the winning scratch card.
  • Vouchers can be claimed by scanning the QR code on the winning scratch card and completing the form. The voucher will be sent by email. The voucher can be used until the date indicated on it (cannot be combined with other promotions)

Web :

  • Prizes can be claimed by scanning the QR code on the winning scratch card and completing the form.
  • The scarf/book will be sent to the address provided.
  • The voucher will be sent by email. The voucher can be used until the date indicated on it (cannot be combined with other promotions)

Wholesale :

The customer can scratch their card at the checkout; if they have a winning card, they can collect their prize directly at the checkout.

 

Article 6. The prize

The prizes available in the Contest are:

All prizes are personal and are not transferable to third parties. The winner cannot exchange or redeem the prize for cash or another prize

 

Article 7. Personal data

The following personal data will be requested from each participant for participation in the Contest:

  • name and surname;
  • email address

The personal data provided will be used solely for the purposes of organising the Contest and will be processed in accordance with Xandres’s Privacy Statement (accessible at https://www.xandres.com/be_en/privacy) and applicable legislation for the protection of personal data (including Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data (GDPR)).
Data processing is done by Jotform. More information at  https://www.jotform.com/privacy/
The Organiser is only authorised to contact the participant regarding promotions, offers, information, other contests, etc. if they have expressly consented to the processing of personal data for purposes other than the organisation of the Contest Participants may, at any time, access their personal data or request the correction or deletion thereof in the manner set out in the Organiser's Privacy Statement (see above for link).
Submitting false, incomplete or incorrect data may result in exclusion from participation for that participant.

 

Article 8. Fraud and abuse

The Organiser will monitor and ensure the proper course of the Contest.
The Organiser reserves the right to exclude participants from the Contest in any of the following cases:
1°      One or more participants who, together or alone, manipulate or fraudulently increase their chances of winning in any way;

2°      Participants who violate the terms of these Contest Rules or any applicable law. The Organiser cannot be held liable for such violations;
3°      Participants who provide false, incomplete or inaccurate personal data;
4°      Participants using automation of the entry fields, automatic publication, falsification of the entry form, or any other software or method that allows multiple entries and/or automation of participation. The above is prohibited and, in addition to immediate exclusion from the Contest, may lead to legal action for Internet piracy.
5°     Participants displaying trademarks, trade names or logos/slogans of companies other than the Organiser's when submitting their entry/participating in the Contest.

 

Article 9. Communication

The winner of a prize grants the Organiser permission to use their name, account name and/or image (by photo or video) free of charge in connection with any communication or promotion by the Organiser regarding the Contest (including through all of the Organiser's social media channels), without the winner being entitled to any additional compensation for such use.

 

Article 10. Liability

Participation in the Contest is entirely at the participant's own risk. The Organiser cannot be held liable for any direct or indirect damages incurred by a participant due to participation in the Contest and receipt, use of or defects in a prize, except in the case of intentional or gross negligence on the part of the Organiser or its agents.

The Organiser cannot be held responsible for technical failures, lack of network connection or failed participation.

The Organiser reserves the right to terminate, modify, postpone, cancel or interrupt the Contest, in part or its entirety, for reasons of force majeure, for other causes beyond the Organiser's control (including, but not limited to, technical incidents or breakdowns) or if required to do so to comply with legislation in a particular jurisdiction. In such case, the Organiser will not bear any liability, and no compensation will be payable to participants.

 

Article 11. Intellectual property rights and portrait rights

If participation in the Contest requires the participant to submit an entry (in the form of texts, drawings, images, sounds, etc.), the participant guarantees that their entry will not infringe any rights, including but not limited to intellectual property rights, privacy rights and portrait rights belonging to third parties. The participant guarantees they have obtained the consent of the owners of the images or texts or anyone heard or seen in the entry. The participant indemnifies the Organiser against claims by third parties in this regard.
The participant agrees that the Organiser becomes the exclusive owner of their entry. The participant hereby waives any rights, including, but not limited to, intellectual property rights (e.g., copyright), to their submission. The participant grants Organiser the free right, unrestricted in time and space, to copy, save, distribute, publish, or publicly communicate the entry in any form or to modify and use in any way without any compensation or additional consent.

 

Article 12. Contact

Participants can contact the Organiser with questions or comments about the Contest in the following manner:

The Organiser will not address disputes related to the wording or interpretation of the instructions, entry questions or winner selection in the Contest.

 

Article 13. Validity

If one or more provisions of these Contest Rules are declared void, illegal or non-opposable, it will not affect the validity of the remaining provisions of these Contest Rules. The provision in question must be interpreted and/or replaced by a valid provision with the same intent and effect or by a similar provision as close as possible to the provision in question.

 

Article 14. Disputes

The Organiser and Participant must attempt to resolve any disputes in connection with this Contest or the interpretation of these Contest Rules amicably in the first instance. If they cannot reach a solution, the dispute must be submitted to the competent courts of the district the Organiser is headquartered in, without prejudice to the jurisdiction of the courts of the participant's domicile. 

 

Article 15. Applicable law

These Contest Rules are governed exclusively by Belgian law.
